Details

The government launched a consultation on the options for proposed changes to fire and rehire protections in relation to benefits, expenses and shift patterns following the introduction of the Employment Rights Act 2025.

The Regulatory Policy Committee (RPC) gave a ‘green’ rating to the options assessment from the Department for Business and Trade on 17 November 2025. This means that we considered it to be fit for purpose based on our scrutiny of the evidence and analysis supporting the case for why regulation is necessary. 

The RPC’s opinion refers to the evidence and analysis presented in the options assessment, not the policy itself.
