Regulatory Finding

This regulatory notice updates, and is intended to be read in conjunction with, the previously published regulatory notices and enforcement notice[footnote 1] and is a result of ongoing regulatory engagement with Kinsman Housing Limited (Kinsman).

The regulator has made the decision to de-register Kinsman from the register of social housing providers under section 118 of the Housing and Regeneration Act (HRA) 2008. In accordance with section 118(2) of the HRA 2008, the regulator has provided Kinsman with notice of the proposal and Kinsman has had the opportunity to make representations to the regulator during that notice period.

Under section 121 of the HRA 2008 a body may appeal against a decision of the regulator to de-register it. The regulator shall not de-register a body while an appeal is pending.

The Case

The regulator maintains a register of providers of social housing. To be eligible for registration, an organisation must demonstrate its eligibility as set out in section 112 of the HRA 2008. The relevant criteria set by the regulator referred to in s112(3) are set out in Guidance for new entrants on applying for registration as a provider of social housing[footnote 2] and include that a provider must meet the Governance and Financial Viability Standard at the point of registration and demonstrate it can sustain its financial viability on an ongoing basis. Under section 118 of the HRA 2008, the regulator may remove a private registered provider from the register if the regulator thinks it is no longer eligible for registration. Kinsman remains in breach of the Governance and Financial Viability Standard. The regulator has assessed that Kinsman has failed to demonstrate that it can sustain its viability on an ongoing basis. As a result, Kinsman has failed to demonstrate that it meets the registration eligibility criteria under section 112(3) of the HRA 2008. The regulator has a statutory duty to maintain the register of social housing providers.
