Published 18 December 2024
Date of release:
22 June 2023
Information request:
For example anyone out there was to invent and new device and apply for a patent is there a list of devices and or technologies that must be reported and or confiscated, if the device is classed as one on the list?
Information released:
The Intellectual Property Office does not ‘report up the chain’ or confiscate any patent applications. A small number of patent applications which relate to national security matters are treated securely and not published until such time as their content is deemed to no longer be classified, but this is done with the full knowledge of the applicants. Further information about national security checks on patent applications can be found on the National security checks on patent applications and Technology prejudicial to national security or public safety webpages.
There are no devices or technologies that must be reported or confiscated under the patent system. Patent applications are made publicly available, approximately 18 months after they are filed (with the exception of the small number of patent applications that are treated securely already referred to).
