Request:

Please can you provide me with the number and percentage of TM8/notices of defence, filed in UKTM oppositions over the last few years.

We need the number of oppositions filed against UK trade marks (and UK designation of IRs) in the last two years and, of those, the number of TM8 defences filed.

Suspended (or cooling-off extended) oppositions can be ignored in these figures.

Can you separate the figures by those with representation and those without?

Please note that:

  1. The total for each CY is the number of cases where the TM7 has not only been filed but served. We have used the served date as the basis for the calendar year.
  2. As we do not have historic records of representation, we have used as a proxy the details of whether the FIRST correspondence sent to both the applicant and to the opponent was sent to an id-agent number or an id-owner number. This is the best we can do to approximate whether the applicant or opponent had representation at the earliest point in the process.
  3. As requested, the figures relate purely to where TM8 forms have been filed. Any requests to extend the period to file the TM8 have been ignored.
  4. The dataset has been limited to only TM7 served cases for which the time period to file the TM8 has passed.
  5. We’ve provided the data for CY 2021,2022 and YTD for this year.
  6. We cannot guarantee the accuracy of the representation breakdowns, but they are the best we can do given the limitations of the data and our systems. The raw case numbers and basic percentages are included. You should be able to get any other percentage breakdowns from the totals provided.
