Item 1: Introduction
1. The Chair welcomed attendees, outlined the agenda and provided the following update on the action from the previous meeting:
i. MoJ to follow up with HMCTS for an update on the procedural issues at some courts – This work is ongoing, with new job cards and guidance for staff being prepared, and is due to be completed by the end of November 2025. HMCTS will provide a final update at the next meeting;
2. The Chair also provided the following update on the outstanding action from the October 2024 meeting:
i. Advisory Group members to liaise with their membership groups to monitor whether the Official Injury Claim (OIC) messaging system is being used inappropriately to circumvent the OIC process and to provide feedback on their findings – no feedback has been received since October 2024, and this action is now closed.
Item 2: MoJ Update
3. MoJ provided an update on the appointment of the Rt Hon. David Lammy MP as Deputy Prime Minister and Lord Chancellor and the appointments of Baroness Levitt KC and Jake Richards MP as Parliamentary Under Secretaries of State.
4. MoJ also confirmed that Sarah Sackman KC MP remains the Minister of State for Courts and Legal Services with responsibility for Civil Justice and that no further changes are anticipated to her portfolio.
5. A short update was provided regarding changes to the membership of the Civil Procedure Rule Committee and the Whiplash Reform Sub-committee. From November, Lady Justice Cockerill will take over as the Deputy Head of Civil Justice and chair of the CPRC, and HHJ Kelly will replace HHJ Bird as the chair of the sub-committee. The OICAG chair also took the opportunity to record their thanks to HHJ Bird for his significant input into the sub-committee and the OICAG.
Item 3: Official Injury Claim (OIC) data and performance update
6. MIB provided an overview of the OIC operational data for the August to September 2025 quarter. The latest public data set was also published on 10 October 2025 and is available on the OIC website[footnote 1].
7. Work continues tackling dormancy at various stages through OIC. Some professional users have been pro-active in removing claims from the ‘pending liability rejected’ stage, and claims in the ‘pending withdrawal’ stage are now being automatically closed after 60 days of inactivity.
8. A platform update was carried out on 27 July. On 30 September, a new code release introduced some changes. This included the digitisation of the RTA Small Claims Protocol Annex C and D form process, which previously required manual completion. Some additional Application Programming Interfaces (APIs) were also updated to ‘one click’ to improve the experience for professional users.
9. MIB confirmed that the system was operating well and that there were no plans for additional changes at present. MIB also noted that the volume of calls to the Portal Support Centre (PSC) remained steady but that telephone calls from professional users with regards to medical reports remain high.
Item 4: Whiplash Reform Programme – Post Implementation Review
10. MoJ provided some details about the upcoming post-implementation review (PIR) of the whiplash reform programme. A call for evidence will be published on 29 October and will close on 22 December. The reforms will be reviewed against the aims at time of launch, which were primarily to reduce the number and cost of whiplash claims. The call for evidence will be published on gov.uk and on consult.justice.gov.uk.
11. The PIR will specifically review the impacts of Part 1 of the Civil Liability Act 2018, the Whiplash Injury Regulations 2021, the RTA Small Claims Protocol and practice direction 27B and the operation of the OIC portal. MoJ noted the level of the tariff will not be reviewed, as it was reviewed in 2024 but that the impact of the tariff will be considered.
12. Members were encouraged to respond to the call for evidence and to provide data where possible. The review will be completed, and the outcomes and recommendations will be published next year.
13. Postscript: The call for evidence was published on 29 October as planned.
Item 5: Member feedback
14. The Chair asked members for any general feedback they wished to put forward.
15. MedCo noted that it would be helpful if API improvements in relation to medical reporting could be considered, and for feedback on any information MIB finds for the reasons for the high volume of calls to the PSC regarding medical reports. MIB confirmed they would let them know.
16. A discussion took place with regards to the appropriate timing for a compensator to obtain witness statements. One member stated when a claimant issues proceedings after a period of inactivity, it can be difficult for the compensator to obtain the statements they need in time. It was pointed out that further evidence can be added at a later stage with a request to rely upon that information.
17. There was a short discussion on moving claims from OIC to Claims Portal Ltd (CPL) and vice versa. The two portals are not connected. One member said they believe that more claims are now being started in CPL, possibly due to increasing numbers of non-tariff injuries. MoJ said this was not reflected in OIC’s data but encouraged members to provide additional data on that point as part of the PIR.
18. MoJ and MIB will continue to discuss feedback regarding system improvements at their regular governance meetings.
Item 6: Next steps
19. The MoJ confirmed that the minutes will be circulated to members for approval before publication on gov.uk.
20. The next quarterly data release will be released in January. MIB will prepare the usual data slides which will be circulated to the group. The next meeting will be scheduled for April 2026.
