Official Injury Claim (OIC) Advisory Group meeting: 24 April 2025, 10am to 11am

Item 1: Introduction

1. The Chair welcomed attendees, outlined the agenda and provided the following update on the actions from the previous meeting:

i. MIB to update the group with any data obtained from their random sampling on dormant claims – Action completed;

ii. MIB to include the number of cases removed from OIC each month for limitation – Action completed;

iii. MoJ to obtain data from CPL to show how many cases were exiting which should have started in OIC and explore whether it is possible to obtain data on how many cases that leave OIC due to value actually do go on to start a claim in CPL – Action completed.

2. The Chair also provided the following update on actions from the October 2024 meeting:

iv. MoJ to reflect on whether any changes should be made to the Advisory Group and to bring any proposed changes to the January meeting for discussion – Action completed.

v. Advisory Group members to liaise with their membership groups to monitor whether the OIC messaging system is being used inappropriately to circumvent the OIC process and to provide feedback on their findings – No update.

Item 2: MoJ Update

3. MoJ provided a brief update on the progress of the Whiplash Injury (Amendment) Regulations 2025, which increase the figures in the tariff by approximately 15%. The Regulations were debated and approved by the House of Commons on 2 April with preparations underway for the second debate in the House of Lords.

4. CPL and MIB both confirmed that they are ready for this change and that communication have/will shortly be provided to users confirming the timing of the changes.

Item 3: OIC data and performance update

5. Tina Flowers was introduced to the group. Tina is replacing Martin Saunders at MIB as Head of Customer Operations

6. MIB provided an overview of the latest quarterly operational data, which was published on the OIC website on 10 March 2025. It was noted that OIC has now surpassed 1 million claims started since launch on 31 May 2021.

7. An update was provided on the random sampling of dormant cases, specifically where liability had been rejected, but no further action was taken. MIB is now working with claimant solicitors to investigate and resolve this, and the number of these cases on OIC is now falling slowly, rather than continuing to rise.

8. In recent months, there has been a rise in the number of users calling the Portal Support Centre asking about obtaining additional medical reports. MIB is working with insurance representatives to understand and mitigate this.

9. MIB continues to work with MoJ on the digitalisation of the Annex C and D forms, with the aim of implementing this in September/October 2025. Some older Application Programming Interfaces (APIs) are being removed from OIC in September 2025 and contact has been made with users to ensure they are using the up-to-date APIs.

Item 4: Member feedback

10. The Chair asked Members for any general feedback they wished to put forward, and in particular with regards to Action Point 3 from the October 2024 meeting - Advisory Group members to liaise with their members to monitor whether the OIC messaging system is being used inappropriately to circumvent the OIC process and to provide feedback on their findings. No feedback was given.

11. One member raised an issue regarding some Courts which were not following the proper procedures. It was agreed that HMCTS would look into this issue.

ACTION POINT 1: MoJ to follow up with HMCTS for an update on the procedural issues at some courts.

Item 5: Next steps and AOB

12. The MoJ summarised the actions arising and next steps and confirmed that the minutes will be circulated to members for approval before publication on gov.uk.

13. Members were encouraged to feedback to their members and to send any suggested topics for the next meeting to the MoJ secretariat by Friday 26 September 2025.

Item 6: Revised date & time of next meeting

14. The MoJ has reviewed the frequency and composition of Advisory Group meetings in line with the group’s terms of reference. It was determined that the current system stability, with most process updates being minor improvements rather than bug fixes, has reduced the need for frequent meetings.

15. There has also been a significant reduction in non-standard agenda items being put forward by MoJ, MIB and/or members. Consequently, MoJ has decided to reduce meeting frequency to two per year, while retaining the current membership.

16. Quarterly data updates will continue to be provided, and members are encouraged to raise issues where they arise. The next OICAG meeting will be held in October 2025.
