Notice to Traders 51/22 - Poultrymeat Import Quota

Introduction

This notice is to inform you of the next round of poultrymeat import quotas which are detailed in Annex 1 attached.

The application period

For the period 1 September to 30 September 2022 you may apply for import licences between 1 August 2022 and 5pm on 5 August 2022.

It is your responsibility to check that the application and all additional documentation is correct at the time of submission.

Note: We will reject any applications, securities or proof of trade received after 5pm on 5 August 2022.

Proof of trade – order numbers subject to reference quantity

If this is your first application of the quota year you must provide evidence to show that you have imported at least 25 tonnes of goods of the same description as that specified on your licence application during each of the two periods:

• 1 April 2020 to 31 March 2021; and

• 1 April 2021 to 31 March 2022.

Proof of trade – order numbers not subject to reference quantity

You must provide evidence to show that you imported at least 25 tonnes of poultry products in each of the periods stated above.

Proof of trade – order numbers 05.4410 and 05.4422

If this is your first application of the quota year you must provide evidence to show that you have imported at least 25 tonnes of goods of the same description as that specified on your licence application during each of the two periods:

• 17 September 2019 to 16 September 2020; and

• 17 September 2020 to 16 September 2021.

You must supply the original import document (C88) form, or a copy certified as a ‘true copy’ of the original stamped by Customs. We will not accept photocopies of the Customs stamp or scanned versions of these documents.

Reference quantity

For order numbers 05.4067, 05.4068, 05.4069, 05.4211, 05.4212, 05.4213, 05.4214, 05.4215, 05.4216, 05.4251, 05.4254, 05.4255, 05.4260, 05.4263, 05.4410 and 05.4422 your application will be subject to a reference quantity.

The reference quantity is the average quantity of goods imported during:

• 1 April 2020 to 31 March 2021; and

• 1 April 2021 to 31 March 2022.

For order numbers 05.4410 and 05.4422 the reference quantity is the average quantity of goods imported during:

• 17 September 2019 to 16 September 2020; and

• 17 September 2020 to 16 September 2021.

The reference quantity can only be made up of goods of the same description relating to the quota concerned.

Declaration of independence

For order numbers 05.4067, 05.4068, 05.4069, 05.4211, 05.4212, 05.4213, 05.4214, 05.4215, 05.4216, 05.4251, 05.4254, 05.4255, 05.4260, 05.4263, 05.4410 and 05.4422 you must provide a declaration of independence (see Annex 2) which must contain:

• a declaration that you are not linked with any other person applying for the same order number; or

• if you are linked with another person applying for the same order number, a declaration that identifies that linked person and evidence that you regularly engage in substantial economic activities with other third parties.

Licence applications

Your application must not exceed the reference quantity or, if it concerns a sub-period, must not exceed the proportion (%) of the reference quantity corresponding with the sub-period (see Annex 1).

However, if you have already used your full reference quantity for an application in the first period you cannot apply in this period.

In box 8, the country of origin:

• you must put a cross in the ‘No box for order numbers 05.4067, 05.4068, 05.4069, 05.4213, 05.4216, 05.4218, 05.4260, 05.4263, 05.4264, 05.4265 and 05.4422 and a cross in the ‘Yes box for all other order numbers.

in box 20, special particulars:

• you must state ‘Statutory Instrument 2020 No. 1432’ and the quota order number that you are applying for.

Supporting documents

If it is your first application of the quota year you must send us a valid VAT certificate when submitting your application. If you are registered as part of a group you must provide a valid VAT certificate that lists each company within the group.

Licence security

Applications must be accompanied by a security of £10 per 100kgs for order numbers 05.4211, 05.4214, 05.4217, 05,4251, 05.4252 and 05.4253, £20 per 100kgs for order numbers 05.4067, 05.4068 and 05.4069, £35 per 100kgs for order numbers 05.4215, 05.4254, 05.4255, 05.4256, 05.4258 and 05.4259, and £50 per 100kgs for order numbers 05.4212, 05.4213, 05.4216, 05.4218, 05.4260, 05.4263, 05.4264, 05.4265, 05.4410 and 05.4422.

In box 11 you should state:

• the amount of security expressed in UKP (£);

• the type of security, for example ‘block guarantee’, ‘cash’ or ‘single transaction guarantee’; and

• the trader number of the block guarantee holder if you are using another trader’s block guarantee.

If you are using another trader’s block guarantee you must make sure that your cross reference details are set up before you send us your application.

Note: We will reject your application if the cross reference is not set up and you do not submit security in another format within the application period.

We will not accept any amendments to block guarantees after the application period has closed. This includes cross reference amendments.

Licence validity

Licences for order numbers 05.4410 and 05.4422 will be valid from 1 August until 31 December 2022.

Licences for all other order numbers will be valid from 1 August 2022 until 30 June 2023.

Release of security

Security against the main electronic licence (excluding extracts) will be released automatically upon attribution of at least 95% of the licence quantity.

Transfer of rights

The rights of a licence may only be transferred to companies that have satisfied the proof of trade requirements detailed in this notice. The rights of a licence can only be transferred once, to the nominated transferee. Further transfers of rights are not permitted, other than to transfer the rights back to the original licence holder.

Animal and public health

To protect animal and public health, all products of animal origin may be subject to veterinary conditions or restrictions. You can call the Animal and Plant Health Agency Carlisle on 01228 403600 for advice on whether and under what conditions imports are allowed.
