In my division, we are starting to look forward to some period of normality and a return to some sort of business as usual after a really challenging year.

Many of the team have been redeployed to other work whether that be taking Universal Credit claims or setting up and running Kickstart. As of last week, most have returned “home” and we are looking at how we can ramp up the work in a virtual environment. You will see below that this includes our HB Performance and Relationship Management activities in the New Year.

That’s not to say we in any way downed tools in the last nine months. We have continued to check in with LAs to discuss resilience and business continuity, for example. We have also continued to look for ways we can support LAs to reduce costs and improve service. Data sharing is always a bit of a minefield but we are really pleased to be able to clarify the art of the possible around data sharing for LCTRS (read on!). Perhaps of less interest to this audience but a huge achievement for us is the launching of the new Blue Badge service in public beta. We have had fantastic feedback on this. Thank you to all the LAs who provided input into its development.

Around this time of year another business as usual activity is the frenetic task of trying to nail down budgets and allocations, having only recently received our Spending Review settlement. It’s always our aim to provide as much information on funding as soon as we can to help you in your local planning and this year is no different. So, as you will see, we are busy working on the allocations of Discretionary Housing Payments. We are also hoping to be able to issue a funding statement in the next couple of weeks covering indicative Housing Benefit administration subsidy and New Burdens allocations. Unfortunately, we can’t yet confirm the Housing Benefit Award Accuracy Initiative or Verify Earnings and Pensions funding levels but plan to do so in the New Year.

We have also taken on the setting up and delivery of the COVID Winter Grant Scheme in England which was launched in record time. I’m really proud of the team for their work here and very grateful to all the LAs who helped us despite the very short consultation period. To confirm, these payments will be disregarded for benefit purposes.

2021 to 2022 Discretionary Housing Payments funding for English and Welsh LAs

1. Discretionary Housing Payments (DHPs) funding has been made available since 2011-12 to enable local authorities (LAs) to provide transitional support to claimants as they adjusted to Housing Benefit (HB) Welfare Reforms.

2. For 2021 to 2022 the government will make available £140 million in DHP funding for LAs in England and Wales to distribute in order to help support vulnerable people with their housing costs. This follows an increase in Local Housing Allowance rates to the 30th percentile in 2020 to 2021 that are being maintained in cash terms for 2021 to 2022.

3. Since the start of the COVID-19 pandemic, we have been closely monitoring the DHP spend and we will continue to do so throughout 2021 to 2022. 

4. The Department for Work and Pensions (DWP) is now working through the allocations for individual LAs and will set these out shortly via a HB circular.

Performance Measurement HB annual programme 2021

6. The Department for Work and Pensions (DWP) informed LAs about plans to restart Performance Measurement HB reviews from January 2021 and that the finalised work programme would be shared with LAs as soon as possible.

7. The HB Performance Measurement process will be the same as previous years however DWP’s Performance Measurement team will now conduct the HB review by telephone rather than by visit.

8. LAs will be allocated a Single Point of Contact by DWP’s Performance Measurement team who will contact the HB Manager or HB Error Control Officer between 6 to 8 weeks of the sample being delivered to discuss the process, timelines and the electronic transfer of documentation. The data from these reviews will be used for DWP’s national Fraud & Error statistics, which the department is planning to publish in May 2022.

9. The Performance Measurement HB annual work programme for 2021 is included in Appendix A.

Further use of HM Revenue & Customs’ real time Pay As You Earn earnings information

11. For many years, LAs have been asking the DWP if they could further use the HM Revenue & Customs’ (HMRC) real time Pay As You Earn (PAYE) earnings information received from DWP for HB purposes for additional reasons as outlined below.

12. DWP has now sought further legal clarification in collaboration with HMRC and this article aims to provide comprehensive clarity on the legality for the most common further use questions raised with DWP.

Local Council Tax Reduction

13. The Welfare Reform Act 2012 and the Social Security (Information sharing in relation to Welfare Services etc.) Regulations 2012 do allow:

  • HMRC to share earnings data with DWP
  • DWP to share with LAs the HMRC earnings data we receive from them, for the purposes of Local Council Tax Reduction (LCTR) administration
  • LAs to hold HMRC earnings data they receive.

14. To avoid the need to send the same HMRC data to LAs twice for the two different purposes, we are delegating the responsibility to LAs to ensure that LA staff “view the HMRC earnings data afresh” when looking at it in the Verify Earnings and Pensions (VEP) portal, for the purposes of the administration of LCTR only cases.

15. What this means in reality is that any LA staff member that uses the HMRC earnings data for LCTR only cases, must act at that moment as if they were only administering LCTR, even if they were to later carry out tasks relating to another benefit or welfare service.

Council Tax

16. DWP can also clarify that the legislation does not allow the HMRC earnings data to be used for Council Tax administration purposes. However, it is worth noting that the Cabinet Office are working with 29 LAs, using the Digital Economy Act governance process, in relation to Council Tax debt collection.

Specific further caveats in relation to the legality

17. However, to be clear, HMRC are not allowing any additional data to be shared and, indeed, the law does not allow this. For example, LAs should not submit non-HB National Insurance numbers in their monthly HB Debt Service submission, as this would result in additional data being shared.

18. Similarly, whilst accessing the information via the VEP portal, LAs will need to set the interest to view the VEP information for non-HB claims. In doing so, they should remember that the interest will be automatically unset on the 27th of the month for any cases that are still not claiming HB. This prevents any unnecessary data being shared and ensures LAs keep within existing legislation.

19. We have updated the Memorandum of Understanding (MoU) between DWP and LAs to take into account the contents of this article. The updated MoU was shared with all LAs on 1 December 2020.

COVID Winter Grant Scheme

21. DWP recently launched the COVID Winter Grant Scheme which sees £170 million of new funding issued to County Councils and Unitary Authorities (including Metropolitan Councils and London Boroughs) to support those most in need across England with the cost of food, energy, water bills and other associated essentials.

22. Following the issue of the launch letter to all LAs on 10 November 2020, DWP has liaised closely with LA colleagues to enable the delivery of this support to vulnerable households. An all LA conference call was held on 12 November 2020 to introduce and discuss the scheme, giving LA leads the opportunity to ask questions and gain an understanding of how the scheme would be delivered. This was well attended and generated lots of positive discussion.

23. A second all LA call was held on 24 November 2020 which was attended by colleagues from the Department for Education and the Department for Environment, Food and Rural Affairs. They provided an overview of the work that they are doing to deliver the wider Winter Support Package. Subsequently the detailed guidance, outlining the delivery framework, was shared directly with all LAs on 24 November 2020 and then published on www.gov.uk

24. The first scheme funding payment has now been made to LAs and they have begun to deliver the scheme in their regions. DWP continue to work closely with all LAs involved in the scheme and a further all LA call will take place in early/mid-December to discuss progress. DWP has also been engaging third party organisations from the energy sector to increase potential contact opportunities for LAs.

25. DWP is grateful for the support and engagement shown by LAs in the delivery of the scheme to date. We would encourage LAs to support each other locally and share good practices and innovations to deliver the scheme on the all LA calls.

Reminder: Procurement of reporting accountants for the 2021 to 2022 HB Assurance Process

27. As part of the HB Assurance Process (HBAP) DWP has published a number of instructional and guidance Modules. Module 1 (which included the standard engagement terms for the HBAP) was issued in March 2018, supported by further guidance in circular HB S7/2018

28. This is a reminder, that as part of the standard engagement terms each LA is required to provide DWP with notification confirming the procurement of a reporting accountant to carry out HBAP testing in relation to subsidy year 2021 to 2022 by no later than 1 March 2021.

29. Included below is the relevant extract from Module 1 of the HBAP guidance.

Role of the LA

30. Module 1 includes the relevant responsibilities and timings pertinent to the receipt of the reporting accountant notification as follows:

  • the LA is required to appoint a reporting accountant by the 1 March prior to the commencement of the financial year for which this procedure will apply, to perform the specific test requirements set out in the DWP’s HBAP modules in force for that year

  • if the LA fails to appoint a reporting accountant by the deadline of 1 March the Secretary of State (SoS) may withhold part or all of subsequent payments of subsidy. The amount and scale of withholdings will be the decision of the SoS. When the LA confirms the appointment of a reporting accountant the subsidy withheld can be released

  • it is for the LA to appoint a reporting accountant to undertake this work and notify the DWP of the successful appointment, no later than the 1 March prior to the commencement of the financial year for which this procedure will apply

Multiple year arrangements covering the 2021 to 2022 reporting period and future years

31. If an LA secured a multi-year engagement with a reporting accountant that covers HBAP in respect of the 2020 to 2021, 2021 to 2022 subsidy year and previously notified the DWP of that engagement, then a further notification is not required.

32. The notification confirming the Audit firm procurement should include:

  • name of the audit firm
  • length of the contract
  • lead audit contact name
  • audit office location

33. The notification should be forwarded to lawelfare.hbassurance@dwp.gov.uk.

Update: Refresh of HBAP modules

34. DWP have recently refreshed HBAP Module X: DWP reporting framework instruction for further work. The updated module will apply to further work requests in respect of the 2019 to 2020 subsidy year.

The NHS Learning Support Fund

37. The NHS Learning Support Fund is additional funding available to NHS students who are receiving a tuition fee and maintenance loan.

There are 6 individual elements to the fund:

  • Training Grant
  • Specialist Subject Payment
  • Regional Incentive
  • Parental Support
  • Travel and Dual Accommodation
  • Exceptional Hardship

38. There is more information here about eligibility for the NHS Learning Support Fund, including entitlement to the individual elements.

Impact on HB and the NHS Learning Support Fund

39. HB regulations state that payments intended to meet additional expenditure which are connected with term time residential study away from the student’s normal home together with travel expenses incurred as a result of attendance on a course shall be disregarded from a student’s grant income.

40. Although the Travel and Dual Accommodation element is not referred to as a grant, DWP can confirm payments can be disregarded from HB when assessing income for NHS students.

41. The other elements of the NHS Learning Support Fund are treated as income and should be taken into account in full.

New Self-Isolation Support Payment scheme (Wales only)

43. On 30 October 2020, the Welsh government announced the new Self-Isolation Support Payment available to those in Wales.

Impact on HB

44. DWP can confirm that the Self-Isolation Support Payment will meet the definition for ‘Local Welfare Provision’ in HB regulations for Working Age claimants, so can be disregarded. As the payments are not listed as income to be taken into account, they can also be disregarded for Pension Age HB customers.

HB decisions by the Upper Tribunal

45. Decision Making and Appeals (DMA) Leeds is aware of the following HB cases that have been decided by the Upper Tribunal (UT):

  • CH/38/18: Spare room subsidy. LA appeal dismissed. Carmichael followed.

  • CH/375/16: Spare room subsidy. Claimant appeal allowed. Carmichael followed.

  • CH/475/15: Spare room subsidy. Claimant appeal dismissed. Carmichael followed.

  • CH/4940/14, CH/4944/14: Spare room subsidy. LA appeal dismissed. Carmichael followed.

  • CH/871/19: Direct payments. Regulation 76(1)(b). 8 week arrears figure should be in respect of amount contractually owed to landlord.

  • CH/1630/15: Spare room subsidy. Secretary of State appeal upheld. Hockley followed.

  • CH/2523/15: Spare room subsidy. Claimant appeal dismissed. Child in question not disabled.
