Details

An Order has been made in relation to an allegation that between 5 April 2019 and 4 April 2022, Ms Duncan in her role as Trustee in Bankruptcy of a debtor’s estate, breached the Fundamental Principle of Professional Competence and Due Care of the Insolvency Code of Ethics, when she:

  • failed to correctly allocate the expenses of the bankruptcy estate; and
  • wrongly deducted expenses of the bankruptcy estate from the realisations of a property, which were held on trust for the purposes of the debtor’s Individual Voluntary Arrangement.

Accordingly, Ms Duncan was found liable to disciplinary action under the IPA’s Articles of Association.
