Between 26 April 2022 and 26 June 2023, Muhammad Usman Nazir FCA, in his capacity as liquidator of “X” Limited, failed to conduct his investigations in accordance with:

• paragraph 8 of Statement of Insolvency Practice 2, effective from 6 April 2016; and/or
• paragraph 9 of Statement of Insolvency Practice 2, effective from 6 April 2016.

This was in breach of R2103.1(b) of the fundamental principle of Professional Competence and Due Care, as set out in the Insolvency Code of Ethics, effective from 1 May 2020. Muhammad Usman Nazir was therefore liable to disciplinary action under Disciplinary Bye-law 4.1(b).
