The department received a request under the Freedom of Information Act 2000 (FOIA) requesting the following:-

  1. Has the Home Office had a policy, either published or unpublished, of granting Exceptional or Discretionary Leave to Remain to applicants from Iraq in the past 5 years?
  2. If there has been such a policy, was this a blanket policy?
  3. If there has been such a policy, what was the time span what was covered by it?
  4. Again, if there was such a policy, what was the Home Office practice with cases that potentially fell under this policy but did not benefit from it due to delays by the Home Office on interviewing such applicants or making a decision on their cases? Would the Home Office entertain a retrospective application of such a policy given their own delay in such cases?
