Extension of UK IP right abroad: countries C to H

1. Cayman Islands

Self-governing UK overseas territory.

1.2 Extension

Patents: The Cayman Islands Intellectual Property Office (CIIPO) extends patent rights that are registered in other jurisdictions. In accordance with The Patents Act (2018 Revision), these jurisdictions currently are those in the United Kingdom and the European Community.

Extending patent rights in the Cayman Islands is relatively straightforward. The rights will be granted once you have paid the prescribed fees, and the registrar is satisfied that your application is in order. The term of protection will expire in the Cayman Islands at the same time it does in the UK or EU.

Note: Applications cannot be filed directly with this office – applications must be done via a locally licenced Patents & Trademarks Agent. Per Section 6 (1) The Patents Act (2018 Revision).

Trade marks: All marks must be filed directly with the CIIPO via a locally licenced Patents & Trademarks Agent.

Cayman Islands nationals may apply for a European Union Trade Mark (EUTM), however, as Cayman Islands legislation allows only for protection of trade marks registered with CIIPO, the right of priority established in Article 29(5) of the EUTM Regulation does not apply.

Designs: To gain protection in the Cayman Islands, you must first register in the UK. Once a design has been registered in the UK, you can then instruct a registered agent to file a copy of the registration with CIIPO at any time after date of granting. The term of protection will expire in the Cayman Islands at the same time it does in the UK.

Copyright: As in the UK, Copyright protection in the Cayman Islands is an automatic right. The Cayman Islands government has extended Part I of the UK’s Copyright, Designs and Patent Act 1988.

2. Cyprus

2.1 Administration

Trademarks, designs, patents and copyright are the principal forms of Intellectual Property (IP) protection available to companies and individuals. IP law, especially for patent protection, is not totally harmonised within the EU. The Department of Registrar of Companies and Official Receiver of Cyprus has responsibility for IP.

3. Falkland Islands

Self-governing UK overseas territory. No longer includes its former dependencies South Georgia and the South Sandwich Islands.

3.1 Own laws

Yes, but no independent registration.

3.2 Extension

Patents: If you apply for a patent based on an existing UK patent, within 3 years of UK date of issue, registration will be granted if the required information is sent with the application.

EP(UK): If you apply for a patent based on an existing EP(UK) patent, within 3 years of EP(UK) date of issue, registration will normally be granted, the patent will expire with EP(UK) patent.

Trade marks: Falkland Islands legislation introduced in 1996 allows for extension of UK right without re-registration - this then expires with the UK trade mark.

Designs: Independent registration is not required.

The Supreme Court of the Falkland Islands is empowered to declare that rights in a UK design have not been acquired in the Falkland Islands on any grounds for cancellation existing under UK law, including publication of the design in the Falkland Islands prior to the UK registration.

4. Fiji

Independent member within the Commonwealth.

4.1 Own laws

4.2 Extension

EP(UK): If you apply for a patent based on an existing UK patent, within 3 years of EP(UK) date of issue, registration will normally be granted, the patent will expire with EP(UK) patent.

Trade marks: In addition to local registration, you may also apply for a registration based on a UK trade mark. Applications can be at any time during the life of the UK trade mark and will expire with UK trade mark.

Designs: No provisions for independent registration – UK designs registrations are automatically extended.

5. Gambia

5.1 Own laws

Yes, “The Industrial Property Act” came into force on 2 April 2007. As a result Gambia will no longer be re-registering any UK patents etc.

Applications for patents, trade marks and designs should be made in Gambia.

5.2 Extension

Patents: If you apply for a patent based on an existing UK patent, within 3 years of UK date of issue, registration will normally be granted, the patent will expire with UK patent.

EP(UK): If you apply for a patent based on an existing EP (UK) patent, within 3 years of EP(UK) date of issue registration would normally be granted, the patent will expire with EP(UK) patent.

Trade marks: Applications must be made within 4 months of UK application and afford the UK filing date as the priority date.

Designs: UK designs registrations are automatically extended.

6.2 Extension

Patents: If you apply for a patent based on an existing UK patent, within 3 years of UK date of issue, registration will normally be granted, the patent will expire with UK patent. PCT applications filed from 1 January 2021, which are subsequently granted in the UK, will automatically provide patent protection in Gibraltar.

EP(UK): A European Patent which is in force in the United Kingdom may be registered in Gibraltar subject to the same conditions as a UK Patent. A certified true copy by the UKIPO of the specification of the granted EU Patent together with the entries made in the UK register must be provided. As from 1 Jan 2021, the Madrid Protocol will apply to Gibraltar in respect of designations of the United Kingdom in international registrations and in subsequent designations bearing a date of January 1, 2021, or later.

Trade marks: you may apply for a registration based on a UK trade mark. Applications can be made at any time during the life of the registered UK trade mark and will expire with UK trade mark.

Designs: UK designs registrations are automatically extended.

8. Guernsey

The Bailiwick of Guernsey, comprising the Island of Guernsey (with the adjacent islets of Herm and Jethou), Alderney and Sark, is a self-governing crown dependency with its own legislative assembly and systems of law and administration including intellectual property laws.

8.1 Own laws

Yes – the Bailiwick’s legislative framework includes trademarks, patent, image rights, designs, copyright, database rights and performer’s rights.

8.2 Extension

Patents: It is possible to re-register UK patents in Guernsey. If you apply for a patent based on an existing UK patent, at any time after the UK date of issue, registration will normally be granted. The patent will expire with the UK patent. PCT applications filed from 1 January 2021, which are subsequently granted in the UK, will automatically provide patent protection in Guernsey.

EP(UK): If you apply for a patent based on an existing EP(UK) patent, at any time after the EP(UK) date of issue registration would normally be granted, the patent will expire with the EP(UK) patent.

Except in the case of persons who are ordinarily resident in the Bailiwick of Guernsey, applications to register patents, change particulars, assign or licenses etc. can only be made by a registered patent agent.

Trade Marks: As of 01 March 2016, a single application process has been introduced, replacing the ‘Primary’ and ‘Supported’ application types. All applications are now treated as new trade mark applications and no applications are required to be supported by a previous registration in another jurisdiction.

Designs: It is possible to re-register UK designs in Guernsey. Application may be made at any time during the life of the UK design, and registration will expire with the UK design. . Any new international design applications under the Geneva Act of the Hague Agreement filed from the 1 January 2021, designating the UK will also be protected in Guernsey.

Under a protocol to the UK’s Act of Accession to the EC the Channel Islands are part of the European Communities for customs and trade purposes, but the provisions on free movement of workers, freedom to provide services, and freedom of establishment do not apply.
