Details

This regulatory position statement (RPS) does not change your legal requirement to comply with your environmental permit.

However, the Environment Agency will not normally take enforcement action if you do not comply with this legal requirement if you meet the requirements in this RPS.

The regulatory position does not apply to any other legal requirements.

  1. Correction to previous update note stating the incorrect waste code. The waste code added for waste wood destined for incineration was 17 02 01. No further updates made to RPS 352.

  2. Added waste code (07 02 01) for waste wood destined for incineration. Added that you must have notified and have the Environment Agency's agreement in writing before 30 September 2025 that you can use this RPS. The withdrawal date for this RPS is 31 December 2025. Operators can continue beyond this date if it is agreed to by the Environment Agency in writing.

  3. The RPS has been updated to allow operators who are impacted indirectly by unplanned downtime of energy from waste incineration plants or biomass plants.
