Environment Agency (NPS/WR/021837, NPS/WR/021993 & NPS/WR/030224): application made to abstract water and impound water

Details of the application

The Environment Agency is applying to the Secretary of State for Environment, Food and Rural Affairs for three licences.

The Environment Agency is giving notice of the applications, in accordance with Section 37 of the Water Resources Act 1991 and Paragraph 2 of Schedule 2 of the Water Resources (Abstraction and Impounding) Regulations 2006.

The first application is for a transfer licence at National Grid Reference (NGR) SK 25859 27540 to transfer water from the River Dove to Clay Mills Leat at Stretton, Burton upon Trent at the maximum quantities as follows:

  • 50,400 cubic metres per hour

  • 1,209,600 cubic metres per day

  • 441,504,000 cubic metres per year

  • at an instantaneous rate not exceeding 14,000 litres per second.

The second application is for the removal of Dove Cliff Weir at Stretton, Burton upon Trent on the River Dove at NGR SK 25869 27541.

The third application is for the removal of Clay Mills Leat Weir at Stretton, Burton upon Trent on Clay Mills Leat at NGR SK 25881 27499.

Further details of the proposal are: the weirs were historically built and modified to provide flood protection to the local area and to provide a flow to Clay Mills Leat. Flood protection is no longer required from these structures and they are currently a barrier to fish migration. Their removal will re-create and reconnect a more natural stretch of river for fish migration and take away the ongoing financial obligation to manage and maintain the weirs. The transfer licence will ensure a flow to Clay Mills Leat continues to be provided.

After 24 May 2019, the Environment Agency will be able to grant a licence authorising the proposal. The licences shall be viewed as granted, unless the Secretary of State, either as a result of any representations made about the proposal or otherwise, instructs or asks for an application to be made to them.
