Draft revised Attorney General’s Code of Practice issued under Section 377A of the Proceeds of Crime Act 2002

Following a public consultation, a revised draft of the Attorney General’s Code of Practice issued under Section 377A of the Proceeds of Crime Act 2002 has been laid in Parliament and will be debated in due course.

Details

The existing Code of Practice needs to be updated in advance of the full commencement of the Criminal Finances Act 2017 (CFA) amendments to the Proceeds of Crime Act 2002 (POCA) in Northern Ireland.

POCA provides that when a Code of Practice is revised, the relevant authorities must prepare and publish a draft, consider any representations made and modify the Codes as appropriate, and lay the Codes before Parliament for approval.

Following a public consultation, which ran from the 1 December 2020 to 22 January 2021, a revised draft of the Attorney General’s Code of Practice has now been laid in Parliament and will be debated in due course.

The Home Office and the Department for Justice, Northern Ireland published consultations on eight further Codes of Practice and the Home Office have laid four further Codes of Practice in Parliament.

Please note that the CFA’s amendments will not be commenced in Northern Ireland until the relevant secondary legislation is passed in Parliament and by the Northern Ireland Assembly.
