The government will strengthen the director disqualification framework. Courts will be able to consider disqualifying an individual following a conviction for a qualifying offence under HMRC securities legislation.
Disqualification will not be automatic. The court will consider the evidence and circumstances of each case before deciding whether to make a disqualification order and, if so, how long the disqualification should last.
The measure aims to strengthen the response to serious non-compliance and support the fairness and integrity of the tax system. It will retain the existing safeguards in the director disqualification framework.
