This guide, originally published in November 2001, has been updated in order to make it clearer to read and understand, bring it up to date and introduce forms for determination applications and appeals. It provides general guidance on the procedures contained in the Building Act 1984 for:

  • applying to the Secretary of State for Communities and Local Government for a determination in respect of the compliance of plans of proposed building work with the Building Regulations; or
  • submitting an appeal to the Secretary of State against refusal by a local authority to relax or dispense with a requirement of the Building Regulations.

Fees

There is a fee payable for a determination application (with the exception for applications relating to building work solely required for disabled persons for which there is no fee). Details of the fee payable are given on the determination application form (see above).

There is no fee payable for an appeal.
