Breach of union rules / register of members decision: Barker v National Association of Colliery Overmen, Deputies and Shotfirers (NACODS)

The Claimant made two complaints: that the union had breached its rules governing the subscriptions payable by honorary members and had breached section 25(1) of the 1992 Act by failing to compile and maintain an accurate and up to date register of its members. The Certification Officer dismissed the first complaint as being outside his jurisdiction and the Claimant withdrew the second complaint, following discussions with the Union. (Sections 108A(1) and 25(1) of the 1992 Act).
