Authorisations under section 36 of the Freedom of Information Act

Q. We were asked to provide information on whether any Ministers within the Wales Office have made authorisations under s36(5)(o)(ii) or s36(5)(o)(iii) of the Freedom of Information Act and in each such case to provide:

  • the date on which the authorisation was made;
  • the identity of the minister;
  • the identity of the public authority; and
  • the text of the authorisation.

A. We have conducted a thorough search of our paper and electronic records and we hold some information relevant. In the Wales Office, the Secretary of State for Wales makes all decisions in relation to s36 exemptions.

These responses include details of any exemptions applied as well as, where appropriate, information as to why this exemption has been applied, including the public interest test determinations made. Further, the Ministry of Justice publish details of all FOI requests, including where exemptions have been applied. This information is available at:

The majority of the request is therefore exempt under the provisions of s21 of the Freedom of Information Act related to information available by other means. This is an absolute exemption and is not subject to the public interest test.
