We have a received a request under the Freedom of Information Act 2000 for the following: 

Please could you confirm that no certificates have been issued to manufacturers of systems which do not comply with the handbook, in particular to paragraph 5.1.2 on page 5 which refers to the information which shall be shown on a violation record. Is it possible that this device was issued a certificate without meeting the requirements or would it be the case that the violation record has been changed from the one produced when the equipment was certificated? If any equipment was issued a certificate without complying with clause 5.1.2 please can you look into how this might happen.

Home Office Science and Development Branch Publication 02/06 (‘Automatic Distance/Time Speedmeter Handbook (2nd ed) Provisional’) is written as a guide to manufacturers intending to submit devices for approval, to indicate what criteria will be used to judge those devices. However we are free to depart from our own guidance should we consider that the product submitted achieves the same result by another equally acceptable method. Therefore we cannot confirm that no certificates have been issued to manufacturers of systems that do not comply with the handbook.
