Consultation description
Summary
This follow-up consultation invites views on two sets of draft Regulations which will underpin the implementation in the UK of legislation arising from the EU’s Thematic Strategy on Pesticides. The first supports the operation of Regulation (EC) No 1107/2009 concerning the placing of plant protection products on the market. The second sets fees and charges to recover the Government’s costs of implementing this and other EU legislation on plant protection products.
This consultation focuses on specific measures to implement the Government’s preferred approach in light of the earlier consultation on options. The policy decisions have been taken and were outlined in the paper published by Defra on 15 December 2010.
We are seeking comments on a limited number of specific points of detail, primarily from those marketing and using plant protection products.
Consultation response
The consultation is now closed. The summary report provides an indication of the breadth of views expressed across the range of stakeholder groups that responded. As a result of the consultation, the Department has maintained the general approach of the Enforcement Regulations, with some technical amendments to certain provisions. The Department has also retained the overall structure of the Fees Regulations, but deleted or adjusted some individual fees and decided not to proceed with some matters which it proposed to fund from the charge.
A summary of responses is available below.
Plant protection regulations
Following the consultation the following regulations take effect from 24 September 2011:
This completes work to give effect to Regulation 1107/2009 in the UK. Work on transposing and implementing the Directive on the Sustainable use of Pesticides (2009/128/EC) - the other key part of the EU Thematic Strategy on Pesticides - is outlined within our pesticide page.
