Detail of outcome

Following analysis of the responses to the wider consultation, regulations have been drafted that reflect the original proposal alongside the additional policy relating to Investment Contracts. These enable but do not require Ofgem to enter into arrangements with the Low Carbon Contracts Company, or the Secretary of State if required in the case of Investment Contracts, regarding advice in relation to FMS arrangements and enforcement, as well as sustainability obligations.

DECC intends to enable Ofgem to continue its existing roles under the Renewables Obligation in relation to Fuel Measuring and Sampling and Sustainability within the Contract for Difference regime. This consultation concerns the policy supporting this approach.
