Detail of outcome

In total, the government received 74 responses to the online form (excluding blank submissions) and 21 email responses. During the consultation period, we also held meetings and roundtables with key stakeholders, including business representatives, trade union representatives and tronc operators.

The government is very grateful to all respondents to the consultation for their considered and helpful responses.

A draft revised code of practice has been published alongside this government consultation response. A new public consultation will be held on this code of practice. The details and timings will be confirmed in due course. For now, employers should continue to follow the existing code of practice.

We will continue to work with stakeholders in tipping industries to help businesses to implement the new requirements and to help workers be informed about their new rights. 

Further information about additional non-statutory guidance will be communicated by the Department for Business, Innovation, Science and Trade (BIST) in due course.

Consultation description

The government is strengthening the law on tipping by introducing new requirements for employers to consult with workers at their place of business when developing or reviewing their tipping policies.

The government is consulting to gather views on the new requirements.

The government is also consulting to gather views on the existing law on tipping and the:

• statutory code of practice on fair and transparent distribution of tips
• non-statutory guidance for distributing tips fairly

This consultation provides an opportunity for all interested parties and groups to:

• review how the existing legislation operates in practice
• identify where improvements could be made
• consider how we can most effectively implement the new requirements
