We have made our final decision on this application and issued the permit variation on the 15 July 2021.

We considered all the responses received during the consultation.

Our decision document explains the reasons for our decision and responds to the matters raised during the consultation.

Before reaching our decision, we ran a second consultation for this application from 4 February 2021 to 5 March 2021, specifically for the Transboundary Impact Assessment (TIA). This was necessary following the UK’s exit from the European Union (EU), where previously Article 37 of the Euratom Treaty would have applied. As such the UK government would have directly sought the opinion of EU member states on similar matters.

We did not receive any responses to the second consultation.

Consultation description

We have received an application from FCC Recycling (UK) Ltd to make changes to its RSA permit at the Lillyhall landfill site in Cumbria. The RSA permit controls receipt and disposal of radioactive waste at the site.

We are seeking comments on this application to change the permit. Public consultation helps us take into account any information that people think is relevant to our decision making. It also gives people the opportunity to understand the proposed changes.

The proposed changes to the permit are to:

  • increase the current activity limits for the disposal of radioactive waste from 4Bq/g (or 40Bq/g for tritium) to a maximum average consignment activity limit of 200Bq/g
  • update the permit to the latest template so that it reflects recent guidance changes
