After you appeal

The Planning Inspectorate will check your appeal to make sure it’s valid. They’ll tell you what happens next and how long your appeal may take.

Their decision about your appeal will be based on:

  • the information you send
  • a site visit
  • your council’s documents, for example the tree preservation order

Your case officer will write to you if they need more information.

You’ll normally get a decision within 27 weeks.

Interested parties

The council may decide to contact anyone who commented on your original application (‘interested parties’). Your case officer will consider the statements any interested parties made.

Interested parties cannot make any further comments during the appeal but can withdraw their original statement.

If anyone behaves unreasonably

You can apply for an ‘award of costs’ if anyone involved in your appeal has cost you money by behaving unreasonably, for example missing deadlines. However, you might have to pay another party’s costs too.

You can complain about how the Planning Inspectorate handled your appeal. There’s no time limit for complaints.
