UK-Brazil international data transfers arrangements: joint statement

The United Kingdom and the Federative Republic of Brazil are engaging in dialogue between the UK Department for Digital, Culture, Media and Sport (DCMS) and Brazil's Agência Nacional de Proteção de Dados (ANPD).

The United Kingdom and the Federative Republic of Brazil are engaging in dialogue between the UK Department for Digital, Culture, Media and Sport (DCMS) and Brazil’s Agência Nacional de Proteção de Dados (ANPD) with a view to exploring the possibility of international data transfers arrangements.

Today, the United Kingdom and Brazil reaffirmed their shared commitment to promoting the free flow of data while maintaining high standards of personal data protection and recognised the important role that trusted cross-border data flows play in supporting economic growth, innovation, public service delivery, scientific research and international cooperation.

Both sides welcomed the steady progress made in their respective assessments and ongoing discussions and agreed to continue technical engagement in the coming months. Each country will determine any future arrangements independently and in accordance with its own legal requirements and procedures.

Waldemar Gonçalves Ortunho Junior, Director-President of Autoridade Nacional de Proteção de Dados - ANPD (Brazil’s National Data Protection Authority) said:

“Brazil and the United Kingdom share a commitment to advancing international cooperation on data protection and enabling trusted cross-border data flows. Our dialogue reflects the importance of ensuring that international data transfers take place in a manner that upholds the protection of personal data, while supporting innovation, economic development and scientific cooperation. The ANPD remains committed to advancing its assessment in accordance with Brazil’s legal framework and applicable procedures.”

Stephanie Peacock, Minister of State in the Department for Digital, Culture, Media and Sport said:

“I greatly value collaboration with Brazil on data, and the constructive discussions as both countries explore international data transfers arrangements. This work builds on the connections our two countries already share, from our trade and investment relationship to long-standing research links between our institutions. Together, these reflect a shared determination to unlock the benefits of the digital economy for businesses, researchers, and citizens in both countries, based on a foundation of high standards of protection.”

These discussions have taken place alongside both countries’ ongoing participation in international data protection fora and discussions on data protection, which supports broader international efforts to promote trusted data flows and high standards of personal data protection.

The United Kingdom and Brazil look forward to continuing their engagement and cooperation as they advance their respective processes for considering future data transfer arrangements.
