DECISION No 2/2022 of the TRADE COMMITTEE of 25 OF FEBRUARY 2022 UNDER THE FREE TRADE AGREEMENT BETWEEN THE UNITED KINGDOM OF GREAT BRITAIN AND NORTHERN IRELAND AND THE REPUBLIC OF SINGAPORE

establishing a list of individuals who are willing and able to serve as arbitrators and a list of individuals who are willing and able to serve as the chairperson of an arbitration panel under the Free Trade Agreement between the United Kingdom of Great Britain and Northern Ireland and the Republic of Singapore

THE TRADE COMMITTEE,

Having regard to the Free Trade Agreement between the United Kingdom of Great Britain and Northern Ireland (the “UK”) and the Republic of Singapore (“Singapore”) (jointly referred to as “the Parties” or individually referred to as “Party”) done at Singapore on 10 December 2020 (“the Agreement”), in particular Articles 14.5 and 14.20 of the Free Trade Agreement between the European Union and the Republic of Singapore as incorporated into and modified by the Agreement (“Incorporated Agreement”),

Whereas:

  1. In accordance with paragraph 1 of Article 14.20 of the Incorporated Agreement, the Parties shall establish a list of five individuals who are willing and able to serve as the chairperson of an arbitration panel referred to in Article 14.5 of the Incorporated Agreement;

  2. In accordance with paragraph 2 of Article 14.20 of the Incorporated Agreement, the Trade Committee shall establish a list of at least ten individuals who are willing and able to serve as arbitrators. Each Party shall propose at least five individuals to serve as arbitrators;

  3. In accordance with paragraph 4 of Article 14.20 of the Incorporated Agreement, arbitrators shall have specialised knowledge of or experience in law and international trade or in the settlement of disputes arising under international trade agreements. They shall be independent, shall serve in their individual capacities, shall not be affiliated with the government of either Party, and shall comply with Annex 14-B of the Incorporated Agreement;

  4. The Parties have agreed on a list of five individuals who are willing and able to serve as the chairperson of an arbitration panel referred to in Article 14.5 of the Incorporated Agreement; and

  5. Each Party has proposed five individuals to serve as arbitrators.

HAS ADOPTED THIS DECISION:

1. Article 1

The lists of five individuals who are willing and able to serve as the chairperson of an arbitration panel referred to in Article 14.5 of the Incorporated Agreement, and of ten individuals who are willing and able to serve as arbitrators, are established as set out in the Annex to this decision.

2. Article 2

This decision shall enter into force on the date of its adoption.
