17 March 2022: Summary of discussion of the first UK-Andean Countries Intellectual Property Sub-Committee

The first meeting of the United Kingdom-Andean Countries Intellectual Property Sub-Committee took place on 17 March 2022 via videoconference.

1. Greetings and opening remarks

The UK chair welcomed Andean and UK colleagues, setting out the UK’s ambitions for the Sub-Committee and bilateral relationship going forward. The Andean countries welcomed the chairs’ comments.

The UK chair welcomed Colombia as an observer who are completing their domestic ratification to accede to the agreement.

2. Adoption of the agenda

The agenda was adopted.

3. Adoption of the Rules of Procedure (RoP)

All parties agreed to adopt the EU-ANDEAN Trade Committee RoP mutatis mutandis for the purposes of this meeting and to adopt the UK-ANDEAN Trade Committee RoP at the next Sub-Committee when they have been finalised.

4. General intellectual property (IP) segment

4.1 Update from the United Kingdom:

The UK provided an update on changes to its IP regime since signature, including recent consultations on Artificial Intelligence, call for views and legislative changes.

4.2 Update from Ecuador:

Ecuador provided an update on changes to regulations linked to the Ingenuity Code, explained Decision 486 [Common Provisions on Intellectual Property], and informed on the recent adoption of Decision 876 [establishing an Andean Common Regime for Country Brands].

4.3 Update from Peru:

Peru also updated on Decision 876 [establishing an Andean Common Regime for Country Brands] and Supreme Decree No. 170-2021-PCM which regulates its Regimes of Traditional Specialities Guaranteed (TSG) and Geographical Indications (GIs).

5. Geographical Indication (GI) update

5.1 Update from the United Kingdom:

The UK presented on its GI scheme, which was launched on 1 January 2021. The UK provided updates on the status of GIs submitted by Ecuador and Peru.

5.2 Update from Ecuador:

Ecuador confirmed that they have not modified any of the GIs listed.

5.3 Update from Peru:

Peru confirmed that they have not modified any of the GIs listed under the Agreement.

Peru answered the UK’s questions on the protection of Irish Whiskey and Irish Cream GIs.

Peru also provided an update on its Traditional Specialities Guaranteed (TSG) Regime and its GI regulation.

6. Next steps, operational conclusions, and joint minutes

The UK proposed next steps, including follow up cooperation, which the Andean Countries agreed to.

7. Closing remarks

The UK, Peru and Ecuador expressed mutual gratitude for the productive and informative meeting, noting that they look forward to further engagements.
