Modifying the Tariff Elimination Schedule of the United Kingdom for goods originating in Colombia in Annex I to the Trade Agreement between the UK of the one part, and Colombia, Ecuador and Peru, of the other part.

The Trade Committee

Having regard to the Trade Agreement between the United Kingdom of Great Britain and Northern Ireland, of the one part, and the Republic of Colombia, the Republic of Ecuador and the Republic of Peru, of the other part, signed in Quito on 15 May 2019 (“the Agreement”), and in particular Article 13(2)(g);

Whereas:

(1) The provisions of the Trade Agreement between the European Union and its Member States, of the one part, and Colombia, Peru and Ecuador of the other part, as amended by its Protocols on 30 June 2015 and 11 November 2016 (“the EU-Andean Countries Trade Agreement”) are incorporated into and made part of the Agreement, mutatis mutandis, subject to the provisions of the Agreement and the modifications in the Annex to the Agreement.

(2) Pursuant to sub-paragraph (n) of paragraph 1 of the Tariff Elimination Schedule of the United Kingdom for Goods Originating in Colombia in Annex I to the Agreement concerning bananas (goods included in staging category ‘BA’) the United Kingdom and Colombia agree that an annual tariff rate quota for bananas originating from Colombia shall apply, for an aggregate quantity of 8,000 metric tonnes at a duty rate of 40 Great British Pounds (GBP) per tonne.

(3) It is therefore necessary to modify the Tariff Elimination Schedule of the United Kingdom for Goods Originating in Colombia in Annex 1 to the Agreement to reflect this tariff rate quota.

(4) The decision to modify Annex I to the Agreement can be adopted within the Trade Committee by the United Kingdom and Colombia, as the signatory Andean Country concerned, pursuant to Article 14(3) of the Agreement, in conjunction with Article 12(4), as it relates exclusively to the bilateral relationship between them and does not affect the rights and obligations of another signatory Andean Country,

Has decided as follows

Article 1

  1. Subsection 1 (Tariff Elimination Schedule of the UK for Goods originating in Colombia) of Section B (Tariff Elimination Schedule of the UK) of Appendix 1 (Elimination of Customs Duties) of Annex 1 (Tariff Elimination Schedules) to the Agreement, is modified as per this Article.

  2. Under point A (Tariff Elimination), in paragraph 1, at the beginning of sub-paragraph (n), insert:

“subject to the Special Tariff Quotas in point C of this Subsection,”

3․ After point B (Tariff Quotas for specific goods) insert:

“C. Special Tariff Quotas

The following tariff rate quota shall apply as from 1 August 2025 to 31 December 2025, and thereafter on an annual basis from 1 January to 31 December each year, to imports into the UK of originating goods listed in staging category ‘BA’. The quota will not be pro-rated in 2025.

(a) The UK shall allow an aggregate quantity of 8000 metric tonnes of goods listed in staging category ‘BA’ at a rate of 40 GBP per metric tonne”

Article 2

This Decision shall enter into force on 1 August 2025.
