This notice is published under regulation 47(2) of the Trade Remedies (Increase in Imports Causing Serious Injury to UK Producers) (EU Exit) Regulations 2019.
Transition of EU trade remedies measure
This notice gives effect to the EU trade remedies measure specified in Notice of determination 2020/06: Safeguard measures on certain steel products – application of tariff rate quotas.
The EU trade remedies measure may be found in Commission Implementing Regulation (EU) 2019/159 of 31 January 2019 imposing definitive safeguard measures against imports of certain steel products.
Duty amount, tariff rate quotas and order numbers
The additional amount or import duty (“the safeguard duty”) applicable to the net, free-at-the-frontier price, before other amounts of import duty, of steel products subject to duty (described below) is 25%.
The safeguard duty is applicable if the relevant tariff rate quota for a steel product is exhausted.
Tariff rate quotas
The tariff rate quotas specified in this notice are divided into 2 periods. The quotas set out in:
- Annex 1 are for the period from 1 January 2021 to 31 March 2021
- Annex 2 are for the period from 1 April 2021 to 30 June 2021
The quotas for each steel product in each period are apportioned to particular foreign countries or territories and allocated to importers in the United Kingdom on a first-come, first-served basis.
Quota allocations cease for the quotas set out in:
- Annex 1, on 30 April 2021
- Annex 2, on 28 July 2021
Any quota for a steel product set out in Annex 1 that is not allocated to an importer on or before 30 April 2021 is added to the corresponding quota set out in Annex 2.
If a quota set out in Annex 2 apportioned to a particular foreign country or territory is exhausted on or before 28 July 2021, an importer may, with the exception of steel product categories 5, 16, 20 and 27 and subject to any limit set out in Annex 3, access the corresponding quota apportioned to ‘all others’.
Order numbers
An importer, citing the order number for the relevant steel product category, must apply to Her Majesty’s Revenue and Customs to access a quota.
An importer applying to access any unallocated quota for ‘all others’ set out in Annex 2 must use the ‘ex quota’ order number.

Limited exception to duty for developing countries and territories
Steel products originating in a foreign country specified in Annex 4 are not subject to the safeguard duty applied by, or the quotas set out in, this notice.
This exception is not available for certain steel products imported from specified developing countries and territories, set out in Annex 5.
