THE SOCIAL SECURITY (CLAIMS AND PAYMENTS) AMENDMENT REGULATIONS 2008

1. At the August 2007 meeting a package of miscellaneous amendments, presented as paper 28/07, were agreed by the Committee. One amendment, to Regulation 3(cb) of the Claims and Payments Regulations, provided for a person already entitled to a Category A (i.e. based on their own contributions) state pension and/or graduated benefit to receive automatically, without claiming, a Category B (i.e. based on the contributions of a spouse or civil partner) state pension.

2. The attached letter from the Department explains that further amendments to this provision are now required urgently before implementation in March. The draft amending regulations follow the letter.

3. There was no discussion of the Regulation (cb) amendment at the August meeting (item 5 of the minutes). Officials are ready to attend the 6 February meeting if required. However, unless we hear from you by close on 28th January it will be assumed that you are content that formal reference is not required.
