Use this reference library to find where we have made positive subsidy or particular market situation (PMS) determinations in previous TRA investigations.

A PMS exists in an exporting country where prices are artificially low, there is significant barter trade or prices reflect non-commercial factors. This may prevent a proper comparison between the export price and the sales price in the exporters’ domestic market.

We will assess whether a PMS is present on a case-by-case basis.

We will examine whether there is a PMS in a country if sufficient relevant evidence arises which makes it necessary or appropriate for us to do so.

A subsidy exists if there is either a financial contribution by a foreign authority which confers a benefit on the recipient (usually an industry or business manufacturing goods) or a form of income or price support within the meaning of Article XVI of the General Agreement on Tariffs and Trade 1994 (part of Annex 1A to the WTO Agreement) received from a foreign authority which confers a benefit on the recipient.
