DPN 3/06: Ending the withdrawal of some registered designs from public inspection

The mandatory deferment from publication by the registrar of certain types of textile, lace or wallpaper designs is no longer in operation. Consequently, as soon as the examiner has completed all processes and no issues are outstanding, the design will proceed to publication and registration as soon as possible.

Deferment of publication

In any design application, applicants must now consent to the publication and registration of the design or designs (Rule 4). If they do not consent to this then they must ask to defer the publication and registration of the design or designs. This acts as an alternative to the old mandatory deferment of certain designs.

Applicants now have a period of up to 12 months from the date of filing in which to request publication and subsequent registration by completing and returning a Form DF2C to us, which must be accompanied by a £40 fee for each design they wish to publish.
