I write in response to an email from you received by my office on 11 August 2025, in which you ask for the following information under the Freedom of Information Act 2000:
All correspondence, memos and briefings sent and received by Francesca Whitelaw KC, interim Biometrics Commissioner, between June 10, 2025 and July 6, 2025, which address, or are related to, the civil liberties and human rights implications of proscribing the group Palestine Action.
While the Surveillance Camera Commissioner is a relevant public authority within the meaning of the Act, the Biometrics Commissioner is not. As your request is directed to me as the Biometrics Commissioner (a post which I took up on 1 July 2025 pending the Government’s appointment of a permanent Biometrics and Surveillance Camera Commissioner), it cannot be addressed as a request pursuant to the Freedom of Information Act.
