Temporary storage of ELVs at a motor manufacturer’s dealership: RPS 205

This regulatory position statement (RPS) only applies to the temporary storage of end-of-life vehicles (ELVs) at a motor manufacturer’s dealership.

If you comply with the conditions in this RPS, you do not need to apply for an environmental permit to temporarily store ELVs at a motor manufacturer’s dealership.

If you cannot comply with the conditions in this RPS and you want to temporarily store ELVs at a motor manufacturer’s dealership, you need to apply for an environmental permit.

This RPS does not apply to any other activity, even if it is under the same legislation. You may still need other permits or licences for other activities you carry out.

Conditions you must comply with

You must:

  • be registered in an approved ELV collection network and offer free take-back of ELVs
  • only dismantle or depollute ELVs if you have an environmental permit authorising this
  • arrange for onward transportation of the ELV to an authorised treatment facility within 7 days of receiving it
  • only store up to 5 ELVs at any one time
  • keep records for 2 years that show you have complied with this RPS – you must make these records available to the Environment Agency on request
  • follow consignment notes and consignee returns procedures for moving ELVs to an authorised treatment facility
  • store ELVs on an impermeable surface with sealed drainage
  • have spill kits on site to deal with any oil, fuel or fluid leaks from the stored ELVs

You must make sure your activities do not endanger human health or the environment. You must not:

  • cause a risk to water, air, soil, plants or animals
  • cause a nuisance through noise or odours
  • adversely affect the countryside or places of special interest

Enforcement

A RPS means that the Environment Agency will not normally take enforcement action against you provided:

  • your activity meets the description set out in this RPS
  • you comply with the conditions set out in this RPS
  • your activity does not, and is not likely to, cause environmental pollution or harm human health

When to check back

This RPS will be reviewed by 30 September 2023. You will need to check back then to see if it still applies or if you need to apply for a new permit.
