Ceramic tableware and kitchenware from China (anti-dumping duty 2398)

Amending the anti-dumping duty rate for Liling Jiaxing Ceramic Industrial Co Ltd on imports of ceramic tableware and kitchenware originating in China.

The Commission, by Implementing Regulation 2020/571 ref L132, is amending the anti-dumping duty rate applicable to Liling Jiaxing Ceramic Industrial Co Ltd on ceramic tableware and kitchenware originating in China. The TARIC additional code specific to this company reverts from additional code B999 to B632.

This regulation applies retrospectively from 13 December 2019.

From 28 April 2020 the application of the anti-dumping duty rate is conditional upon presentation to customs authorities of the member states of the documents in Annex 2 or Annex 3.

Products affected

The products are currently classified within the following commodity codes:

  • 6911 1000 90

  • 6912 0021 11

  • 6912 0021 91

  • 6912 0023 10

  • 6912 0025 10

  • 6912 0029 10

The difference between the amended duty rate and the actual duty collected (including during the registration period from March 2019 to December 2019) may be reclaimed from customs authorities (subject to the three year rule).

When an amount is to be reimbursed, the interest to be paid should be the rate applied by the Central European Bank to its principal refinancing operations, as published in the C series of the Official Journal of the European Union in the first calendar day of each month.

Repayment of anti-dumping duty

Traders (including CFSP) who are entitled to repayments of ADD are required to submit claims to the National Duty Repayment Centre or to NIDAC if the entries were within the last four month, on form C285:

Claims must include a copy of the original import declaration and commercial documents such as invoices and transport documents. To receive a quicker and more secure repayment please include bank details with the claim so that the bank account can be credited directly.

Annex 2

If the importer buys directly from the Chinese exporting producer, the import declaration must be accompanied by the commercial invoice bearing a declaration of the exporting producer as follows:

Manufacturer declaration for direct export sale

A declaration signed by an official of the manufacturer, in the following format, on the valid commercial invoice:

  1. The name and function of the official of the manufacturer.
  2. The following declaration: ‘ I, the undersigned, certify that the (volume in kg) of ceramic tableware and kitchenware sold for export to the European Union covered by this invoice was manufactured by (company name and address) (TARIC additional code) in the People’s Republic of China. I declare that the information provided in this invoice is complete and correct.’
  3. Date and signature.

Annex 3

If the importer buys from a trader or other intermediate legal person, whether located in mainland China or not, the import declaration must be accompanied by the commercial invoice from the manufacturer to the trader bearing a declaration of the manufacturer and by the commercial invoice from the trader to the importer, as follows:

Manufacturer declaration for indirect export sale

A declaration of the Chinese manufacturer, signed by an official of the manufacturer issuing the invoice for this transaction to the trader, in the following format, must appear on the commercial invoice of the manufacturer to the trader.

  1. The name and function of the official of the manufacturer.
  2. The following declaration: ‘ I, the undersigned, certify that the (volume in kg) of ceramic tableware and kitchenware sold to the trader (name of the trader) (country of the trader) covered by this invoice was manufactured by our company (company name and address) (TARIC additional code) in the People’s Republic of China. I declare that the information provided in this invoice is complete and correct.’
  3. Date and signature.
