TfL Contractual Requirements audit standards: DVSA earned recognition

Introduction

This document details the standards of the scheme, the assessment and evidence required during an audit to attain the Transport for London (TfL) Contractual Requirements additional module status.

It is a public document and allows both the operator and the auditor to identify the areas where standards are being fully met, part met, or not met.

Each of the applicable standards must be attained in order to meet the overall criteria and the operator should be able to demonstrate full and effective control in all cases. It is not possible to be entirely prescriptive in all cases, as each operator must be considered individually.

It is up to the operator to demonstrate the systems they have in place satisfy the required standards.

The auditor must have a thorough understanding of the requirements and document clear evidence of the standard being met.

Important note

To meet the requirements set out in TfL’s terms and conditions which align with both Work Related Road Risk (WRRR) and Construction Logistics and Community Safety standards (CLOCS), an audit is required in addition to the mandatory DVSA earned recognition standards audit. Operators need to have met the version of the heavy goods vehicles (HGV) standards or the public service vehicles (PSV) standards on GOV.UK at the time of their periodic audit.

The operator must first satisfy all the applicable standards in sections 1 to 10 of the HGV or the PSV DVSA earned recognition standards. Once they have done this, the operator can choose to meet the additional requirements in this optional module.

After passing this module, operators can bid for these types of contract:

  • TfL
  • FORS Silver
  • Construction and Logistics and Community Safety (CLOCS)
  • Work Related Road Risk (WRRR)
  • Direct Vision Standard (DVS)

Meet standards for individual licences or operating centres

As this is an optional module, operators can choose to apply these additional requirements to an individual operator licence, an individual operating centre or the entire entity which is part of the DVSA earned recognition accreditation. This would include all the associated specified vehicles on the selected licences or operating centre applying for this module, rather than all the entities and licences in the DVSA earned recognition accreditation.

The DVSA earned recognition accreditation published list of accredited operators will clearly identify the status of the operator licences or operating centres that have achieved the TfL Contractual Requirements module standards in addition to DVSA earned recognition accreditation.

When to apply for a DVSA earned recognition module audit

This module will need to be audited annually. Reaccreditation can take place no earlier than 10 weeks before the anniversary date of the module being awarded and no later than 2 weeks before. This allows an 8-week window in which to achieve the reaccreditation.

Example

Accreditation is awarded 23 June 2022 with an expiry date of 23 June 2023. The earliest date the reaccreditation audit can take place is 14 April 2023 (10 weeks prior), but the audit must be completed by 9 June 2023 (2 weeks in advance of expiry date).

If reaccreditation is carried out earlier than the 10 weeks prior to the anniversary date the operator will forfeit the original accreditation date and a new certificate will be awarded with an expiry date 12 months from the new accreditation date.

Example

Accreditation is awarded 23 June 2022 with an expiry date of 23 June 2023. Reaccreditation takes place on 26 March 2023 (over 10 weeks prior to expiry). The new expiry date will be 26 March 2024.

Vehicles specified on operator licences with this module would need to include additional check items for the periodical safety inspections, which will be included as part of the maintenance system key performance indicator (KPI) report.

We advise operators to discuss any changes that may affect their earned recognition accreditation status with the DVSA earned recognition team, as it could be more cost effective to bring the periodic audit forward to combine with an application for this module.

Operators will need to inform the authorised audit provider of their intention to contract for TfL or CLOCS associated tenders and to ensure the appropriate audit sections are complete. Failure to do so may result in the operator being excluded from TfL or CLOCS contracts.

Once the audit has been successfully completed, DVSA will notify the applicant of the accreditation status of each licence or operating centre in the application.

The operator’s DVSA earned recognition and TfL Contractual Requirements module accreditation status will be published on GOV.UK and will be listed alongside their operator licence name and number. This will be aligned to the operator licence number displayed on their operator licence disc, which is displayed on the vehicle’s windscreen.

Once accreditation has been awarded

Vehicles and drivers entering sites which are required to have achieved the TfL Contractual Requirements standards must follow these rules:

  • vehicles must carry an identifier - this can be placed in the window when arriving on site to identify the vehicle as being in the DVSA earned recognition scheme
  • TfL will audit and spot check operators’ vehicles and drivers for compliance - operators and drivers must cooperate with the TfL examiners
  • drivers must carry training records if training has not been uploaded to the TfL portal
  • drivers must carry a TfL pack confirming transport managers’ name and telephone number that they can hand to the enforcing office

1. London’s Direct Vision Standard (DVS) and Safety Permit

Requirements

This section (1. London’s Direct Vision Standard and Safety Permit) only applies to operators that operate or travel into Greater London, regardless of transport industry sector they work in.

The Direct Vision Standard (DVS) and safety permit for heavy goods vehicles (HGVs) requires operators of lorries over 12 tonnes gross vehicle weight to obtain a safety permit before entering and operating in Greater London.

To ensure a minimum standard of a driver’s direct field of view and reduce the risk of close-proximity blind spot collisions.

Once the below standard has been achieved along with a standards met DVSA earned recognition audit, the operator will meet the requirements of the Construction and Logistics and Community Safety (CLOCS) standard and Transport for London (TfL) Work Related Road Risk (WRRR).

Assessment criteria

1.2 Direct Vision Standard (DVS) and road safety policy for operating HGVs in Greater London. Name, number, review date of policy.

Give overview of the content of the policy. Does it cover additional safety requirements, use of and maintenance of the equipment.

Plans to increase DVS star rating prior to next review in October 2024 when a minimum standard will be 3 stars.

What are the procedures in relation to the permit, when a vehicle has been taken out of service (scrap) or sold on?

How is this policy circulated to the relevant staff? Give evidence that the policy has been read and understood. Note the format it was delivered.
1.3 Procedures in place to ensure the vehicles are correctly rated and a permit is applied for. Evidence the procedure used to ensure all vehicles are correctly rated and have the correct permits.

Vehicles rated 0 star must have photographic evidence to support the application of a permit to evidence the safety system being fitted.
1.4 What number of vehicles in the fleet are 0 rated, 1 to 2 star, or 3 to 5 star rated? Check fleet list or matrix for details of vehicles’ star ratings, permit numbers and expiry dates of permits.

Ensure correct permits have been acquired.

2. Vehicle Safety Equipment which meets TfL Contractual Requirements

This section relates to:

  • Work Related Road Risk (WRRR)
  • London Lorry Control Scheme (LLCS)
  • Construction Logistics and Community Safety (CLOCS)
  • Direct Vision Standards (DVS) Safe System

Requirements

To enhance road safety by improved vision of vulnerable road users.

To assist in minimising collisions with vulnerable road users.

Assessment criteria

Subsection Assessment criteria Evidence requirement
2.1 Policy - to ensure all vehicles where required are equipped with the ‘safety system’ equipment as a minimum and to ensure the equipment is always in full working order and drivers are fully trained on the use of the equipment. Policy name, number, review date, who is responsible for the policy.

Overview of the content.

Evidence the policy has been distributed to all relevant staff and signatures have been obtained confirming the document has been read and understood. Give details of dates and how policy was distributed.

What is the process regarding aspects of the equipment being switched off, and when this is and is not acceptable? For example, audible warning system to enable it to be muted between the hours of 11:30pm and 7am.

Evidence the drivers have been fully trained in use of the equipment and its importance. In what format and frequency does the training take place? Give details.
2.2 All vehicles where applicable (over 3.5 tonnes) must have a class V mirror fitted to the nearside of the vehicle (unless the vehicle is left-hand drive, then to the right) and a class VI mirror fitted to the front of the vehicle. Sample 10% of the fleet of vehicles to ensure correct mirrors are fitted.

Give registration number, type of vehicle, make and model.

Submit photographic evidence.
2.3 Prominent pictorial warning stickers advising vulnerable road users of the hazards around the vehicle. Sample 10% of the fleet of vehicles and trailers to ensure pictorial warning stickers are fitted.

Give registration number, type of vehicle, make and model.

Ensure the warning stickers are clean and not faded, of the correct size and type, and situated in the correct place so they are easily visible to vulnerable road users. Warning stickers must not be offensive or instructional.

Submit photographic evidence.
2.4 Side underrun protection is fitted to both sides of the vehicle, except where this is impractical or proves impossible. Sample 10% of the fleet of vehicles to ensure side underrun protection is fitted to the vehicle where applicable.

Give registration number type of vehicle make and model.

On unseen vehicles check for invoicing of retrofitted equipment or vehicle specification documentation.
2.5 Audible alerts - audible vehicle manoeuvring warning shall be fitted to warn vulnerable road users when a vehicle is turning left.

To meet the requirement of WRRR, the audible alert must also sound when the vehicle is reversing.
Sample 10% of the fleet of vehicles to ensure an audible alert is fitted to the vehicle.

Give registration number, type of vehicle, make and model.

Submit photographic evidence.

On unseen vehicles, check for invoicing of retrofitted equipment or vehicle specification documentation.
2.6 Blind spot aids - a fully operational camera monitoring system with an in-cab display shall be fitted to the vehicle to monitor nearside blind spots.

To meet the requirements of WRRR, the camera must also be capable of monitoring the rear of the vehicle.
Sample 10% of the fleet of vehicles and trailers to ensure camera systems are fitted to the vehicles where applicable.

Is the camera system capable of digitally recording and storing data for future driver training and incident recording and investigation?
2.7 Close proximity sensors - a sensor system that alerts the driver to the presence of a vulnerable road user shall be fitted to the nearside of the vehicle. Sample 10% of the fleet of vehicles and trailers to ensure close proximity sensors are fitted to the vehicle, where applicable.

Give registration number, type of vehicle, make and model.

Submit photographic evidence.

On unseen vehicles, check for invoicing of retrofitted equipment or vehicle specification documentation.

3, 4 and 5. Additional training requirements

Requirements

To undertake specific training courses in relation to work-related road safety, Work Related Road Risk (WRRR), Construction Logistics and Community Safety (CLOCS) and the London Lorry Control Scheme (LLCS). This includes training specific for the urban environment, including on-road experience from a cyclist’s perspective, which is required to be completed at least once every 5 years.

Where the service provider operates delivery and servicing vehicles to provide the services, the service provider shall ensure that each of its drivers attend approved progressive training throughout the term of the contract.

A minimum of 90% of the drivers which are employed must have completed the training. The tolerance is to allow for driver recruitment.

3. HGV drivers (including wheeled plant) mandatory courses

3.2 Work Related Road Risk (WRRR) CPC course completed every 5 years.

Must complete training courses in relation to vulnerable road users, Work Related Road Risk, and requirements of Construction Logistics and Cyclist Safety (CLOCS) once every 5 years.

The syllabus must meet the requirements required for Work Related Road Risk, vulnerable road users CLOCS.

Vulnerable road user training must include on-cycle hazard awareness.
Check the training matrix for the dates the course has been carried out and that all required staff have undertaken this training within the last 5 years - give details of any discrepancies.

Ensure that refresher training is scheduled in the training matrix.

Give details of the training that has been taken - the training course undertaken must have been approved by at least one of TfL, DVSA earned recognition or an alternative standards provider.

Was the training undertaken in-house or via a third party? Give details?

Is the course approved via the DVSA national standards and accreditation department and listed on the JAUPT website as a Driver CPC course?

3.4 Fuel emissions and air quality training e-learning course completed within last 24 months. Name of course, type (for example, e-learning or CPC), duration and frequency of training given.

Evidence all relevant staff have been trained in the subject, attended, and read and understood any literature given in relation to the training.

Ensure the details are recorded on the training matrix and forward planned to ensure training is retaken no more than 24 months apart.

To allow for ongoing driver turnover and recruitment, a 10% tolerance in the number of drivers that have undertaken the required training may be accepted. Give details of the number of drivers who have completed the training.

3.5 Security and counter terrorism e-learning module completed within last 24 months. Name of course, type (e-learning or CPC), duration and frequency of training given.

Evidence all relevant staff have been trained in the subject, attended, and read and understood any literature given in relation to the training.

Ensure the details are recorded on the training matrix and forward planned to ensure training is retaken no more than 24 months apart.

To allow for ongoing driver turnover and recruitment, a 10% tolerance in the number of drivers that have undertaken the required training may be accepted. Give details of the number of drivers who have completed the training.

3.6 One of the following additional safety-related e-learning modules must be completed every 12 months:

Cycle safety
Pedestrian safety
Smart driving
Bridge smart
LoCITY for drivers

5. Managers or responsible person mandatory courses

5.3 Fuel and emissions completed within last 5 years. Give details of the training that has been taken - has the training course been approved by TfL, DVSA earned recognition or an alternative standards provider?

Evidence all relevant staff have been trained in the subject, attended, and read and understood any literature given in relation to the training.

Ensure the details are recorded on the training matrix and forward planned to ensure training is retaken no more than 5 years apart.
5.4 A dedicated person must be appointed to promote positive environmental improvements by monitoring fuel consumption and emissions.

Relevant training must be undertaken in relation to monitoring and management of fuel and emissions as an e-learning module completed within last 5 years.
Give details of who the dedicated person is and what training they have received in relation to monitoring and managing of fuel consumption.

5.5 A dedicated person must be appointed to promote and improve road safety standards. This will be achieved through monitoring and analysis of the data surrounding road risk and collision investigation.

Relevant training must be undertaken in relation to road risk management and collision investigation as an e-learning module completed within last 5 years.
Give details of who the dedicated person is and what training they have received in relation to monitoring and managing of fuel consumption.

6. Minimising adverse effects to the environment - fuel consumption monitoring

Requirements

To implement where possible reduced fuel consumption and Vehicle emissions to minimise the impact on the environment

  • a matrix must be in place to calculate mileage, fuel consumption, carbon dioxide (CO2) output, nitrogen oxides (NOX) output and AdBlue usage

Assessment criteria

6.2 Process in place to monitor fuel usage against vehicle type and distance travelled. Fuel usage and distance travelled shall be used to calculate miles per gallon (MPG), report CO2, NOX, and particulate matter emissions.

On initial application, the data should cover a period of no less than 3 months. At a periodic audit, the data should cover no less than 12 months.

Explain the process used to monitor fuel usage and emissions output. Where is the data collated from - telematics, fleet operator systems, fuel card reports? Ensure the data is from a reliable source.

Where applicable diesel to AdBlue ratio (also known as diesel to AdBlue usage) must also be recorded and monitored.

Is the data gathered in the correct format by vehicle registration number (number plate) and type?

Give an overview of the year-on-year comparison, reasons for rises and falls in figures, and following years targets.

Training requirements for TfL Contractual Requirements module

To allow for ongoing driver turnover and recruitment, a 10% tolerance in the number of drivers that have take the required progressive training may be accepted. Justification of the tolerance being used will be investigated at audit.
