Judicial Summary
Rule 12(3)(a) of the HESC Rules cannot operate so as to extend the time for making an application beyond the 6 month time limit for which Equality Act 2010 provides. However, the FtT erred in law in its approach to the 2010 Act’s provisions allowing an application for extension of time to be considered.
