Judicial Summary

The TC confused the concept of having been found to be professionally wanting as a Transport Manager with a proposed Transport Manager having no experience at all and as a result found that the latter lacked good repute. Insufficient reasons were given as to why curtailment of the operator’s licence of 20%was appropriate and it appeared that the lack of professional competence influenced his decision as to the nature and degree of regulatory action.
