This advice note explains the approach taken by the Planning Inspectorate, on behalf of the Secretary of State (SoS), when identifying consultation bodies to be notified and, where relevant, consulted on the scope of the Environmental Statement (ES) in accordance with the Infrastructure Planning (Environmental Impact Assessment (EIA)) Regulations 2017 (the 2017 EIA Regulations).

Change added to the top of the Advice Note: The Infrastructure Planning (Miscellaneous Provisions) Regulations 2024 came into force on 30 April 2024 and amend the Infrastructure Planning (Applications: Prescribed Forms and Procedure (APFP)) Regulations 2009. Any implications resulting from these changes are not addressed within the current version of this advice. Updates to reflect these changes will be made as soon as is practicable. In the meantime, where relying on this advice, applicants are advised to undertake their own due diligence to ensure that any relevant requirements of the updated legislation are adhered to.
