Importing bicycles from Sri Lanka (anti-dumping duty 2416)

Re-imposing anti-dumping duty on imports of bicycles whether or not they are from Sri Lanka, following the judgment of the Court of Justice in case C-251/18 Trace Sport SAS.

Following judgement of the Court of Justice in case 251/18 the Commission re-opened the anti-circumvention investigation concerning imports of certain bicycles to correct the irregularity identified by the Court.

By implementing regulation number 2020/1140, OJ ref. L248, the Commission has re-imposed the anti-dumping duty on certain bicycles consigned directly or indirectly, from Sri Lanka, with effect from 25 September 2012.

The measure covers the following non-motorised products:

  • bicycles
  • other cycles
  • delivery tricycles

Unicycles are not included.

This regulation takes effect from 1 August 2020.

The current commodity codes of the products are:

  • 8712 0030 10
  • 8712 0070 91

The imports from City Cycle Industries were outside the scope of this investigation but are covered by Commission Implementing Regulation (EU) 2018/28, 9 January 2018.

Customs authorities will not continue the registration of imports which started on 3 December 2019.

Any claims for repayment and remission of the duties, on the basis of the judgement in case C-251/18, cannot now be considered valid.
