Number of oppositions registered under Class 25- 2019-2023

Request:

Under the Freedom of Information Act 2000, I would like to know the following:

  1. The number of oppositions to trade marks registered under Class 25 (footwear and apparel)
  2. The names of the parties to these disputes (both claimants and defendants)

If you cannot answer both questions 1 and 2, please prioritise answering question 1.

I would like the data broken down for each of the last five years with a year-end date of 30 June.

If you cannot provide data for each of the last five years, then please provide data for each of the last four years. If you cannot provide data for the last four years, then please provide data for the last three years etc

There are some caveats and clarifications that you should be aware of:

  1. We cannot identify if a case has been opposed specifically on Class 25 unless it was a single class application.
  2. In the cases where a multiple Domestic class application has been opposed we can only confirm that the case opposed either historically had a Class 25 application or currently retains a Class 25 element.
  3. In the case of International Registration (IR) cases, we can only tell if a case currently has a Class 25 element; we cannot identify accurately historic classes filed. It is therefore possible that some oppositions to Class 25 IR cases may not be included in this data as the class may have been removed successfully as part of an opposition.
  4. The counts have been made for total oppositions but we’ve also split them by whether the opposition related to a Domestic TM or IR.
  5. The dates have been set as requested but to be clear, not all cases will have the opposition closed and so the date we have used to break the figures down by year is the served date, which is the date the opposition was issued to the applicant.
  6. We’ve also put in the raw data the current status of the application and also of the opposition.
