1. Provider Regulation

Provider Regulation monitors the performance of foundation trusts (FTs) to identify the risks of them falling below the required standard once authorised. If a provider of essential NHS services gets into serious difficulty and is likely to be unable to continue providing them, Provider Regulation supports commissioners to ensure that those services continue to be provided for patients. This directorate has 3 divisions:

  • enforcement: deals with the more complex regulatory action
  • monitoring: continues to monitor the performance of FTs
  • finance, reporting and risk: responsible for Monitor’s internal finances and procurement activity, as well as setting accounting and reporting rules for NHS foundation trusts, reporting on the performance of the sector, and managing the financial support for foundation trusts in distress

2. Provider Appraisal

Provider Appraisal assesses NHS trusts seeking FT status. The team also reviews significant transactions involving FTs such as investments, acquisitions or mergers.

3. Co-operation and Competition

Co-operation and Competition enforces conditions in Monitor’s licence which relate to patient choice and competition, as well as our competition law powers. The team carries out Monitor’s enforcement functions in relation to health sector procurement.

4. Sector Development

Sector Development focuses on developing the rules, incentives and capabilities the sector needs to sustain its performance for patients. This directorate has 4 main functions:

  • pricing: ensures healthcare is purchased and paid for in a way that enables and promotes economic, efficient and effective services for patient - Monitor is jointly responsible for the NHS payment system with NHS England
  • strategy and policy: responsible for developing policy, influencing the sector through thought leadership, managing key stakeholder relationships and developing Monitor’s corporate strategy and business plan
  • economics: supports the delivery of projects that inform regulatory decisions for the sector - the team is responsible for developing Monitor’s understanding of the operation of each of the local health economies in England
  • knowledge and information management (KIM): responsible for data management, providing a high-level analysis service and managing our IT services and information systems

Legal Services works with all functions to identify and manage legal risk and provides advice on executing Monitor’s statutory functions and duties. Monitor’s board secretariat function sits within Legal Services.

6. Strategic Communications

Strategic Communications develops and drives our stakeholder communications and engagement programme. The team promotes Monitor’s work, protects and enhances our reputation, and ensures all stakeholders have access to useful, timely and engaging information.

7. Organisation Transformation

Organisation Transformation is responsible for fostering Monitor’s high performing culture, recruiting the right people with the right skills and developing our talent from within.

8. Patient and Clinical Engagement

Patient and Clinical Engagement ensures all our regulatory decisions have appropriate clinical input. The team works with our regulatory functions to identify, meet and quality assure their clinical and patient engagement requirements.
