Detail

You can appeal if:

  • the local authority refuse consent or grant it subject to conditions

  • You have applied for removal or variation of a condition (or conditions) imposed on a previous grant of HSC and the local authority has refused the application or imposed different conditions

  • you have applied for any consent, agreement or approval required by a condition attached to a previous grant of HSC, but the local authority has refused to give it

  • you have applied to the local authority under Section 17 of the Act for the continuation of a HSC upon partial change of ownership of the land and the local authority has refused the application

  • the local authority has failed to issue a decision within the period allowed (i.e. 8 weeks from the date of receipt of the application, or any extended period agreed in writing with the local authority).
