We consider that this information is exempt from disclosure under section 40(2) of the Freedom of Information Act (FOIA) as it relates to the personal data of identifiable individuals. Although the information requested may not directly name those individuals, disclosure would allow their identity to be determined by piecing together the requested information with other information already within the public domain or which is otherwise available to the requester.
Disclosure of this information would therefore constitute the disclosure of third-party personal data. We have considered whether disclosure would be lawful under Article 6 of the UK General Data Protection Regulation (GDPR) and are satisfied that no lawful basis for disclosure applies. The disclosure of this information would not be fair or transparent and would breach the data protection principles.
On this basis the information is exempt from disclosure under section 40(2) of the FOIA. This exemption is absolute and we do not need to go on to consider the public interest test.
