These conditions were agreed on the understanding that:

Ministry of Justice (MOJ) Commercial were to conduct a risk assessment of the appointment and create a clear plan to ensure that Kier Group did not gain competitive advantage from the appointment before the applicant started their new role at Kier Group. This was to be reassessed by the department once the CWAS3 framework was released.

MOJ Commercial were to consult with Kier Group’s competitors to ensure that they were aware of the appointment and mitigations put in place before the applicant started in their new role at Kier Group.
