Regulatory action

27 October 2016: NHS Improvement issued in respect of paragraph 2 (financial governance) of the trust’s enforcement undertakings accepted by NHS Improvement on 24 February 2015. NHS Improvement is satisfied that paragraph 2 of the undertakings has been completed in its entirety.

27 February 2015: Monitor’s investigation found that the trust is breaching its licence to provide healthcare services on a sustainable basis. Monitor has a certificate of compliance (PDF, 16.6KB, 1 page) to ensure the trust addresses its short term and long term financial challenges.

22 August 2014: the trust is no longer subject to enforcement action and in breach of its licence after making significant improvements to the care it offers patients. Please note the following paragraphs from the trust’s enforcement undertakings (issued 25 April 2013) (PDF, 1.63MB, 11 pages) :

  • paragraph 1.9 (“Urgent Care Plan”): the trust has not met all Referral to Treatment targets sustainably for at least 3 consecutive quarters from Q3 2013/14 and it is now not possible for it to do so due to the passage of time. Monitor is satisfied with the steps the trust has taken to improve its Referral to Treatment performance. No further action is required.

  • paragraph 2.2 (“Mortality Plan”): the trust has met all subsections except 2.2.3.3. It is now not possible for the trust to comply with this undertaking. Monitor is satisfied with the steps that the trust has taken to improve its mortality performance. No further action is required.

9 June 2014: the trust was removed from special measures after making improvements in services for patients.

19 March 2014: Monitor issued a certificate of compliance (PDF, 195KB, 1 page) in respect of paragraph 3.1 to 3.7 of the trust’s Enforcement Undertakings agreed on 25 April 2013 which relates to “the Paediatric Plan”. In relation to paragraphs 3.8 and 3.9 of the Enforcement Undertakings Monitor accepts that these paragraphs are now redundant, as Basildon and Brentwood Clinical Commissioning Group does not consider a further external review necessary. Monitor is therefore satisfied that paragraph 3 of the undertakings has been completed in its entirety.

16 July 2013: The trust was served notice that it will be put in special measures to fix failings in patient care and hospital governance identified by Prof Sir Bruce Keogh.
