Detail of outcome

The Department received 816 responses to the consultation setting out a wide variety of views and concerns about this proposed legislation. The Department has considered the responses in full and decided to introduce these provisions to ensure that those who suffer at the hands of a negligent registered health professional can get compensation. It is right that the healthcare professional should take responsibility for making sure the right arrangements are in place.

The draft Order will be laid in Parliament shortly.

Consultation description

The government wants to hear views on legislation that would mean all regulated healthcare professionals have to hold indemnity or insurance to practise.

The vast majority of healthcare professionals are already covered by their employer’s arrangements, however this legislation would ensure that patients are protected by law if things don’t go according to plan. If a patient suffers harm as a result of negligence, they will be able to seek compensation.
