You usually need to do this within one month of receiving the letter.</p>\n\n<h3 id=\"housing-benefit-paid-directly-to-your-landlord\">Housing Benefit paid directly to your landlord</h3>\n\n<p>Your landlord may be asked to repay the money if they’re responsible for an overpayment. For example, if:</p>\n\n<ul>\n  <li>the information you gave was wrong</li>\n  <li>you did not report a change in your circumstances straight away</li>\n  <li>you gave the wrong information when you reported a change of circumstances</li>\n  <li>a mistake was made with your payment</li>\n</ul>\n\n<p>Find out <a href=\"/benefit-overpayments/how-to-make-a-repayment\">how to make repayments</a>.</p>\n\n<div role=\"note\" aria-label=\"Information\" class=\"application-notice info-notice\">\n  <p>There’s a different system <a href=\"/benefit-overpayments/repayments-when-someone-has-died\">if the person overpaid has died</a>.</p>\n</div>\n\n","slug":"when-repayments-have-to-be-made","title":"When repayments have to be made"},{"body":"<p>The Department for Work and Pensions (<abbr title=\"Department of Work and Pensions\">DWP</abbr>) can recover benefit overpayments from a person’s estate.</p>\n\n<p>An overpayment could have happened because, for example, the person who died:</p>\n\n<ul>\n  <li>had more savings than they declared in their benefit claim</li>\n  <li>had not declared an income</li>\n  <li>was in hospital or a nursing home and had not told <abbr title=\"Department of Work and Pensions\">DWP</abbr>\n</li>\n</ul>\n\n<p>If you’re dealing with the estate, <abbr title=\"Department of Work and Pensions\">DWP</abbr> will write to you once <a href=\"/applying-for-probate\">probate has been granted</a> to ask for the information they need.</p>\n\n<div role=\"note\" aria-label=\"Information\" class=\"application-notice info-notice\">\n  <p>You should not distribute the estate until you know what needs to be repaid. If you do, you may have to pay back the money yourself.</p>\n</div>\n\n<h2 id=\"what-you-need-to-do\">What you need to do</h2>\n\n<p>You’ll be asked to provide information to help work out if anything needs to be repaid.</p>\n\n<p>You may need bank statements, building society passbooks or other information about the dead person’s assets.</p>\n\n<div role=\"note\" aria-label=\"Information\" class=\"application-notice info-notice\">\n  <p>If you do not provide the information asked for, the overpayment will be calculated based on the probate figure before any deductions (that is, the whole estate).</p>\n</div>\n\n<h2 id=\"if-there-has-been-an-overpayment\">If there has been an overpayment</h2>\n\n<p><abbr title=\"Department of Work and Pensions\">DWP</abbr> will write to you asking for the money back from the estate. They will tell you how any overpayment has been worked out and explain why it happened. They will also tell you how to pay.</p>\n\n<p>If you need to discuss your payment, or setting up a repayment plan, call <abbr title=\"Department of Work and Pensions\">DWP</abbr>’s Debt Management Recovery from Estates. You can pay back the overpayment in full or set up regular monthly payments.</p>\n\n<h2 id=\"get-help-with-your-repayments\">Get help with your repayments</h2>\n\n<p>Contact <abbr title=\"Department for Work and Pensions\">DWP</abbr> Debt Management if you need help managing your repayments. They can talk you through your options, including what you can afford to pay.</p>\n\n<div class=\"contact\">\n<p>DWP Debt Management contact centre<br>\nTelephone: 0800 916 0647<br>\n<a href=\"https://www.relayuk.bt.com\">Relay UK</a> (if you cannot hear or speak on the phone): 18001 then 0800 916 0647<br>\n<a href=\"http://dwpdmmenu.signvideo.net\">Video relay service</a> for British Sign Language (BSL) users - <a href=\"https://www.youtube.com/watch?v=Osx7FFxFpNY\" data-youtube-player=\"off\">check you can use the service</a><br>\nCalling from abroad: +44 (0)161 904 1233<br>\nMonday to Friday, 8am to 7:30pm<br>\n<a href=\"/call-charges\">Find out about call charges</a></p>\n</div>\n\n<h2 id=\"if-you-do-not-pay-back-the-money\">If you do not pay back the money</h2>\n\n<p>If you do not pay back the money or contact the <abbr title=\"Department for Work and Pensions\">DWP</abbr> Debt Management contact centre, they may:</p>\n\n<ul>\n  <li><a href=\"/make-benefit-debt-deductions\">ask your employer to make deductions from your pay</a></li>\n  <li>pass your case to an independent debt collector</li>\n  <li>pass your case to the <abbr title=\"Department for Work and Pensions\">DWP</abbr> Debt Enforcement Team</li>\n</ul>\n\n<h3 id=\"if-your-case-is-passed-to-an-independent-debt-collector\">If your case is passed to an independent debt collector</h3>\n\n<p>You’ll get a letter to tell you about this from one of the following debt collection agencies:</p>\n\n<ul>\n  <li>Advantis</li>\n  <li>BPO Collections</li>\n  <li>CCS Collect</li>\n  <li>Moorcroft</li>\n  <li>Past Due Credit</li>\n  <li>Resolve Call</li>\n  <li>Shakespeare Martineau</li>\n</ul>\n\n<p>You should deal directly with the debt collector to arrange repayment.</p>\n\n<h3 id=\"if-your-case-is-passed-to-the-dwp-debt-enforcement-team\">If your case is passed to the <abbr title=\"Department for Work and Pensions\">DWP</abbr> Debt Enforcement Team</h3>\n\n<p>You’ll get a letter from the team asking you to set up a repayment plan.</p>\n\n<p>If you do not contact the team or if you do not follow your repayment plan, the team will submit a claim against you to HM Courts and Tribunals Service (<abbr title=\"HM Courts and Tribunals Service\">HMCTS</abbr>).
