On 7 September 2022, North Devon Council (“the applicant”) made a formal application to the Marine Management Organisation (“MMO”) under Section 16 of the Harbours Act 1964 for a Harbour Empowerment Order (“HEO”).

Details

If made, the proposed HEO would define the limits of Lynmouth Harbour. The proposed HEO would also modernise and consolidate the statutory harbour powers applying in relation to Lynmouth Harbour to, formally appoint the applicant as statutory harbour authority for the Lynmouth Harbour, establish an advisory body or bodies consisting of harbour stakeholders, provide modernised powers of management and control of Lynmouth Harbour to vest in the applicant including provisions relating to powers of general direction and special direction, for the making of byelaws, navigational safety, conservation, dredging, moorings, bunkering, levying of charges and the use of harbour revenue; and powers to vest in the applicant which include the power to borrow, to establish a reserve fund, to develop or dispose of land, and to grant tenancies.

More information about the proposals can be viewed in the statement in support and the draft HEO. The statutory 42-day public consultation on the HEO starts 14 July 2023 and ends on 24 August 2023. Be received before the expiry of a period of 42-days consultation period;

Be made in writing and quoting reference HRO/2022/00007;

State the grounds of the objection or representation;

Indicate who is making the objection or representation; and

Give an address to which correspondence relating to the objection or representation may be sent.
